Dem senator warns of political danger on Supreme Court vote

Claire McCaskill (Mo.) announced she would not support President Trump's Supreme Court nominee, Neil Gorsuch.

During his confirmation hearing earlier this month, Gorsuch refused to answer questions about the identities of JCN's funders.

Now, facing a threatened Democratic filibuster that would effectively raise the threshold for Gorsuch's confirmation to 60 votes instead of 51, Graham is prepared to join in the so-called "nuclear option". As Senator Charles Grassley said, "If you'd filibuster Judge Gorsuch, it's obvious you'd filibuster anybody".

But the same applies to Schumer - and even more so, because there is no reasonable basis for blocking Gorsuch, whose qualifications and temperament are beyond doubt. Gorsuch's nomination needs the backing of eight Democrats or Independents, along with all 52 Republicans, to break a filibuster.

While Republicans are no doubt encouraged by the betrayal of barely-Dems in the Senate, Gorsuch's confirmation is still far from certain. "That has happened, and had Hillary Clinton succeeded in winning, I can assure you that I would have allowed her nominee an up-or-down vote".

As of Friday morning, 34 Democrats oppose Gorsuch, including New Hampshire Sens.

Although such a change might seem procedural or obscure, it is known on Capitol Hill as the "nuclear option" because it would amount to a dramatic departure from Senate norms of bipartisanship and collegiality. "I think that's the view of the vast majority of my colleagues".

According to Politico, progressive groups are already planning to lobby the Democratic Senatorial Campaign Committee to withhold campaign funding for the two Democrats, both up for reelection in 2018, and any other Democratic senator that supports Gorsuch. Claire McCaskill, who says she is torn over how to vote, highlighted the dilemma for Democratic senators running next year in states that Trump won.

In an online post, McCaskill explained: "I can not support Judge Gorsuch because a study of his opinions reveal a rigid ideology that always puts the little guy under the boot of corporations". He is mild-mannered but deeply conservative, in the mold of the justice he would replace, Antonin Scalia, who died in February 2016. Forty-one votes are required to prevent the super-majority vote that would end debate on Gorsuch's nomination.

"The American people could have said 'That's unacceptable, ' and therefore elect Democrats to control the White House and the Senate, they could have done that, and we would have had to live with that effect", Toomey said.
