Michigan to pay nearly $100 million in Flint lawsuit settlement

MI will allocate $87 million for the city of Flint to identify and replace at least 18,000 unsafe water lines by 2020 under a proposed settlement of a federal lawsuit that also provides the state with a road map to end free distribution of bottled water. If Judge David Lawson OKs the deal, the Flint and MI governments would be obligated to dig up, inspect and replace lead or galvanized-steel water lines leading to at least 18,000 homes by January 1, 2020.

The state agreed to pay $87 million, with another $10 million ready, in case more pipes need replacing, The Washington Post reports. Obama pledged $80 million in funding to MI to address drinking water issues during a visit to the state in January 2016.

Flint was under the control of a state-appointed emergency manager when it switched its water source to the Flint River from Lake Huron in April 2014.

Based on this, many residents in Flint will still be using water filters for the next three years.

The settlement also requires the city maintain at least two centers where residents can pick up free bottled water and tap water filters through September, and longer if city water testing still shows too much contamination.

Despite the development, some residents still feel discouraged. "For the first time, there will be an enforceable commitment to get the lead pipes out of the ground", said Dimple Chaudhary, the plaintiffs' lead attorney.

The 92-page settlement will be presented to a judge for his approval on Tuesday morning. Instead, if the deal is approved, Flint residents will be able to call the city's 211 number and order free water for delivery within 24 hours. The project's coordinator said he has a goal of finishing the pipe replacements for residents in 2019 by fixing 6,000 service lines a year.

MI will also expand Community Outreach and Resident Education programs in order to provide education, installation, and expansion of water filters.

Flint switched back to the previous water system in October 2015. The state also will continue to go door to door in the city through December 2018 to make sure people have properly installed water filters and to provide new filters and replacement cartridges.

The researchers from Virginia Tech said they found no detectable levels of lead in 57 percent of homes during the latest round of tests in the city.
