Cities, sheriffs find flaws in United States immigration detainer list

Cities, sheriffs find flaws in United States immigration detainer list

ICE's recent action in courthouses has been, in part, driven by an increase in the number of local law enforcement agencies that refuse to comply with ICE requests to detain suspects in county jails, she said.

Fine print: ICE says the list was based on its expectation that jurisdictions would decline all detainer requests based on past responses.

Officials are speaking out against an federal Immigration and Customs Enforcement list they say is aimed at shaming communities that identify as sanctuary cities and towns.

Cambridge is listed as one of five uncooperative municipalities in Massachusetts-including neighboring Somerville and Boston-which "will not honor ICE detainer [s]".

According to the report, ICE issued 3,083 detainers during the week of January 28 to February 3.

"You can't expect local law enforcement to be an arm of the federal government in this process, just like you can't expect them to audit taxes", said Bemis.

Section 15 of the president's "Enhancing Public Safety in the Interior of the United States" executive order, states: "Except as otherwise provided in this order, the Secretary and the Attorney General shall each submit to the President a report on the progress of the directives contained in this order within 90 days of the date of this order and again within 180 days of the date of this order".

"The county is not releasing undocumented individuals that ICE is asking for in the community", said Keller. Montgomery County, Iowa, and Snohomish County, Wash., both tied for fourth with 12 ignored detainer requests each.

Widely publicized immigration sweeps, anti-immigrant rhetoric on the state and national levels, and a stream of proposed new laws targeting the undocumented have created churning dread for people who are in North Carolina without required papers.

Currently, ICE picks up about two inmates a month from the local jail.

"I don't think there is a feeling that we are being singled out", Wagner said when asked about the county apparently being named a few times.

But the counties in our Washington say they can't hand over the targets of immigrant detainers - even if they wanted to.

Search continues for cobra that escaped from Florida home
The Ocala Star Banner has reported that a very venomous tan and yellow monocled cobra has escaped from a Florida home. She said the snakes are typically shy, tend to hide from people and only strike if threatened.

The county's undocumented residents also face the question of whether to report crimes, because doing so might lead to their status being uncovered. The mid-Feburary raids occurred after the Travis County Sheriff's Office stopped allowing ICE agents to detain inmates without warrants space on February 1. In past administrations, he said, detainers were supposed to be used only for serious criminals.

Wagner added that it's hard to comment on whether the numbers ICE gives are an accurate reflection of the immigration detainers the county has declined to honor, because the sheriff's office does not know how or from where ICE gathered the data.

ICE's count only includes declined detainers that agency personnel are aware of.

Magill said the jail's contract with ICE has nothing to do with how local law enforcement conducts its work. But, in a hint of their changing strategy, federal agents said more enforcement is needed in places such as Travis County where local authorities don't fully cooperate with them.

"ICE would prefer that our policy to be that if an ice official calls us and asks us to hold someone beyond their release date, that we would hold them beyond their release date for 48 hours", said Keller.

Also included are cities that have publicly announced policies of non-cooperation.

"This is not thoughtful, comprehensive immigration reform", Chavez said. It lists a total of ten counties.

Unlike many politicians, however, most of the nation's sheriffs, who operate about 85 percent of USA jails, are supportive of Trump's efforts to deport the many illegal aliens within our borders.

"We will continue collaborating with them to help ensure that illegal aliens who may pose a threat to our communities are not released onto the streets to potentially harm individuals living within our communities", he said in a statement. One remains in custody at Franklin County Prison; the other two were transferred to state Department of Corrections facilities, according to Commissioner David Keller.

"If ICE wants us to hold them for additional time, ICE should get a warrant", said Ajeenah Amir, a city spokeswoman.

"I believe that, constitutionally, local governments can not be forced to comply, to help ICE", Sánchez said Tuesday.
