The New Travel Ban Goes Into Effect Tonight

"The Trump Administration may have changed the text of the now-discredited Muslim travel ban, but they didn't change its unconstitutional intent and effect", California Attorney General Xavier Becerra said in a statement.

It was the latest legal move in a series of court challenges to a new travel order signed by Trump last week that temporarily blocks refugees and travelers from six Muslim-majority countries from entering the United States.

Critics say the new order is still essentially a ban on Muslims coming to the United States and therefore unconstitutional because it singles out people of a certain religion for discrimination.

Trump's plan - a revision of that earlier executive order, which was blocked in federal court - keeps refugees from entering the USA for 120 days and has a three-month suspension of visas to citizens of Yemen, Sudan, Syria, Libya, Somalia and Iran.

The amended lawsuit, filed Monday, asks U.S. District Judge James Robart of Seattle to rule that a preliminary injunction he issued against the first order remains in effect for the revised travel ban.

Lawyers for Hawaii argued that the revised ban still runs afoul of the Constitution, saying that it discriminates regarding visas based on nationality and religion.

In addition to Washington and California, states participating in the suit are Maryland, Massachusetts, New York and Oregon.

On Friday, Robart ruled that neither the Justice Department or the states had properly teed up the issues for him, and requested more formal briefings.

The states collectively will also be filing around 50 new "declarations" setting forth numerous harms they claim to face under the new executive order, which is slated to go into effect on Thursday.

A Justice Department attorney is arguing that there's no need for a judge in Hawaii to issue an emergency restraining order against the revised travel ban issued by President Donald Trump. Unlike the earlier version, the March 6 order explicitly exempts from the ban natives of the targeted countries who have gained legal USA residency or hold valid US visas.

The Maryland hearing was the first of several taking place across the country Wednesday on whether federal judges should block it from going into effect.

"President Trump's new travel ban is no different", they wrote, and it "has not overcome the constitutional and legal deficiencies that led courts to enjoin his first travel ban". A federal judge in Madison acknowledged some "important differences" between the original executive order and the new one, but ultimately concluded this particular Syrian family faces "a significant risk of irreparable harm" given "the daily threats to the lives plaintiff's wife and child remaining in Aleppo, Syria".

The new battle against Trump's order is being played out on several geographical fronts, but mainly on the west coast, which tends to be pro-Democrat. Trump, he said, has not used similar rhetoric as president.

There's no denying, however, that the Trump administration will have a much stronger case defending the revised ban compared with the original one.
