Sgt Elor Azaria convicted of the crime of occupation

An Israeli soldier who shot a wounded Palestinian after he had been disarmed was convicted of manslaughter on Wednesday.

Azaria was caught on video fatally shooting al-Sharif after the Palestinian had stabbed a soldier in Hebron in March.

Footage appeared to show the Palestinian motionless on the floor before he was shot.

Other citizens, and many senior military figures, believe the shooting can not be justified and that Azaria, who made far-right, anti-Palestinian postings on Facebook before being conscripted, acted in cold blood and outside military procedures. The judge, Col. Maya Heller said his testimony was "evolving and evasive".

The manslaughter charge can carry a jail term of up to 20 years, although observers say a sentence of four to five years is more likely if Azaria is found guilty.

As the lengthy verdict was delivered and the judges' position became increasingly clear, Azaria's supporters demonstrated outside military headquarters, snarling traffic.

He disparaged criticism of the military, saying, "We must keep the army outside every political argument.and keep it in the widest consensus in Israeli society". Qasrawi died and al-Sharif was wounded in the assault.

They said that an officer had earlier carefully turned over al-Sharif and his companion to check if they were wearing bomb belts.

The incident with Azaria and Sharif took place during a wave of knife and gun attacks on Israelis by Palestinians and Israeli Arabs in Israel and the West Bank.

The court is scheduled to convene at the defence ministry building in Tel Aviv at 10am local time (08:00 GMT) and later issue a verdict in the high-profile case that raised questions over rules of engagement towards perceived threats by Palestinians.

Before handing down their verdict, judges told Azaria that they believed he had shot Sharif "without reason".

Outside the court on Wednesday, supporters of Azaria reportedly chanted "Gadi, be careful".

The soldier's father criticised the judges' decision, saying they had accepted "the B'Tselem version" of events, according to the report.

About 400 protestors gathered outside the military court to support Azaria.

A poll conducted by the Israel Democracy Institute and Tel Aviv University last month found 47 per cent of the country supported killing a violent terrorist on the spot, while 45 per cent said a captured attacker should be handed over to the authorities.

"Human Rights Watch has documented numerous statements since October 2015, by senior Israeli politicians, including the police minister and defense minister, calling on police and soldiers to shoot to kill suspected attackers, irrespective of whether lethal force is actually strictly necessary to protect life", the report stated.

Attorney-General Avihai Mandelblit defended Israeli military justice which "fulfills its job independently, without fear or bias, through professional legal considerations alone".

The rare conviction of a solider like Azaria has polarized public opinion in Israel.
